Applicability

1. These Terms and Conditions apply exclusively to Business-to-Business (B2B) sales.
2. These Terms and Conditions apply to all offers, sales and quotations between Discosmash BV and any customer established in the European Union.

Orders

1. An order constitutes an offer to purchase. The agreement is only concluded after order confirmation or shipment of the products. We reserve the right to refuse or cancel orders before shipment.

Invoices & Offers

1. Obvious errors or mistakes in an offer or quotation do not bind the company.
2. The customer has 1 week to complete payment otherwise the invoice expires.
3. This offer is only valid if a deposit is paid with the order (minimum 30%), if this is not done in 2 weeks the offer expires.

Prices and Payment

1. All prices include VAT unless otherwise stated.
2. Payment must be made in full before shipment

Delivery

1. Delivery times are indicative. The risk passes to the customer upon delivery. Ownership only passes after full payment.

Warranty

1. We offer a warranty of 24 months on all of our physical products on a Return to Base policy.
2. The warranty is exclusively applicable for the first buyer.
3.  To make use of the warranty you need to provide Discosmash with the serial number(s) and the original invoice.
4. Warranty does NOT cover normal wear and tear, misuse, negligence, accidents, incorrect installation, faulty wiring, failure to follow instructions, unauthorized modifications or repairs, or use outside the specified specifications, warranty only covers manufacturing and design defects.

liability

1. The liability of Discosmash is limited to foreseeable damage and the invoice amount, to the extent permitted by law. Consumer rights remain unaffected.

Jurisdiction

1. Any dispute shall be handled by the ondernemingsrechtbank in Antwerp.

1. Product descriptions, specifications, drawings, and images are for informational purposes only and do not form part of the agreement. Minor changes for improvement or to comply with legal requirements are permitted.
